General Terms and Conditions (GTC) for prickstop.com and womofix.de

1. Scope

These General Terms and Conditions apply to all orders placed via the online shops prickstop.com and womofix.de between Jactio e.U. (hereinafter referred to as the “Seller”) and its customers.

2. Contracting party

3. Conclusion of the contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the button to complete the order with an obligation to pay, you submit a binding offer to purchase the goods contained in the shopping cart.

After we receive your order, you will receive an automated order confirmation by email. This initially only confirms receipt of your order.

The purchase contract is concluded when we expressly accept your order, dispatch the goods or send you a shipping confirmation.

4. Prices and payment

All prices stated in the online shop are in euros and include any statutory value added tax applicable.

The prices displayed in the online shop at the time of the order apply. Any additional shipping costs will be shown to you in the checkout before you complete the order.

Payment is made using the payment methods offered in the checkout. Depending on the payment method selected, the terms and conditions of the respective payment service provider may also apply.

5. Delivery and shipping

Delivery is made to the delivery address specified by you within the delivery areas offered in the online shop.

The available shipping methods, shipping costs and estimated delivery times are displayed in the online shop or in the checkout.

If, exceptionally, an ordered item is unavailable or delivery is significantly delayed, we will inform you as soon as possible.

6. Right of withdrawal and voluntary return policy

Consumers are entitled to the statutory right of withdrawal in accordance with the applicable legal provisions.

Details of the statutory right of withdrawal, the consequences of withdrawal, returns and our additional voluntary 30-day return policy can be found in our separate withdrawal and returns policy.

You can declare your withdrawal in particular by email to shop@womofix.de or use our electronic withdrawal form.

Our voluntary return policy does not restrict the statutory right of withdrawal.

7. Warranty

The statutory warranty rights apply.

For consumers, the mandatory statutory provisions of the applicable consumer law apply in particular.

For business customers, any differing statutory provisions remain unaffected insofar as legally permissible.

8. Retention of title

The delivered goods remain our property until the purchase price has been paid in full.

9. Liability

We are liable in accordance with the statutory provisions.

Liability for intent and gross negligence and for damage arising from injury to life, body or health is not restricted.

All mandatory statutory liability provisions apply without restriction in relation to consumers.

10. Applicable law

Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as it does not restrict mandatory consumer protection provisions of the country in which the consumer has their habitual residence.

11. Jurisdiction

For consumers, the statutory rules on jurisdiction apply.

If the customer is a business, a legal entity under public law or a special fund under public law, Vienna, Austria, is agreed as the place of jurisdiction insofar as legally permissible.

12. Data protection

Information on the processing of personal data can be found in our Privacy Policy, which is available at any time in the online shop.

13. Changes and errors

Obvious typographical, printing or calculation errors as well as technical display errors in the online shop do not give rise to claims based on an obviously incorrect price or service description.

Contracts already concluded remain unaffected by subsequent changes to these General Terms and Conditions.

14. Final provisions

If individual provisions of these General Terms and Conditions are wholly or partially invalid or unenforceable, the validity of the remaining provisions remains unaffected.

The applicable statutory provisions shall take the place of the invalid provision.
